The State of Mexico has established a precedent in the legal framework, since, as of May 22 of this year, the prohibition of applying for a CV with a photograph to work in the state and municipal governments came into force, opting for the “blind curriculum”, in which only the qualities, aptitudes, knowledge, name and profession of the citizen came into force, without including data such as address, because it prejudges origin; sex, so as not to discriminate against gender. In addition to the study center, marital status, and finally the photo that implies that the applicant is influenced by the physical appearance.
These reforms carried out in the Law to Prevent, Combat and Eliminate Acts of Discrimination, and to the Law on the Work of Public Servants of the State and Municipalities, pave the way for the implementation of more inclusive recruitment and selection strategies.
Recalling that, in Mexico, in April 2023, a group of senators presented a proposal that proposes to reform articles 2, 3, and 604 of the Federal Labor Law, to prohibit companies from requesting a curriculum with elements such as photography, age, gender, nationality or educational institution. The purpose of this is to prevent discrimination in the selection processes, in addition to seeking to make the recruitment processes transparent through a notice to applicants who were not elected, explaining the reasons for not continuing with the selection and the reasons for hiring another profile.
Although the proposal does not consider special fines, it does seek to establish that labor courts deal with cases of recruitment discrimination, including the request for a curriculum with biases such as those mentioned above.
This bill has yet to be discussed in Senate committees, and although the blind curriculum is not a definitive solution for all hiring biases, it is a valuable tool that can contribute to a selection process without discrimination.
